Complaint of Intimidation And Harassment Filed Against Local 221

The labor management team member who was served charges from Local 221 has responded by filing with the PERB an Unfair Labor Practice charge against SEIU Local 221.

In his complaint, Wally Gutierrez alleges that Local 221 has violated the Meyers-Milias-Brown Act (MMBA).

Section 3506 of the MMBA states: "Public agencies and employee organizations shall not interfere with, intimidate, restrain, coerce or discriminate against public employees because of their exercise of their rights under Section 3502."

This is an outrage! I cannot believe that I am witnessing an appointed un-elected board attempting to outcast my elected representative. These are the actions I would expect to see from a third world dictatorship, not a democratic organization. I find the recent actions of the SEIU shameful and un-American. When the County hired me eight years ago it was Brother Gutierrez who encouraged me to join the union. Brother Gutierrez has always been pro union and his efforts have benefited the union and the employees that he represents. Brother Gutierrez has come to the aid of his fellow county employees many times even though doing so has resulted in retaliatory action against him and caused him personal hardship. The only disloyalty I see here is in the appointed board members in the union who are not acting in my best interest as a member. Brother Gutierrez is a valuable asset to the cause of employee rights; we do not want to loose him. Dose the E board plan to eliminate all of my elected officials and appoint their own?

The elected labor management team for the CR unit is caring out the will of the members that they represent. This union’s management needs to pull it together and get with the program before the County finishes contracting out the rest of our jobs.
